Agreement
Sunshine-private.com offers rooms, vacation apartments and houses to rent through the web site www.sunshine-private.com. Sunshine-private.com acts exclusively as an intermediary of the above mentioned accommodations. All cases of booking are dealt exclusively in the contract between the landlord and tenant. Sunshine-private.com is therefore not a tour-operator in the sense of §651 a BGB. Beside the quality of the properties legal agreements are required. We meet these with you as tenant through agreements of the following booking circumstances. These will come to be the content of the contract to be worked out between you and us. Please read carefully through the conditions.

Legal Conditions
These are effective by the legal regulations of the Federal Republic of Germany.

Final Agreement
Bookings are binding when the tenant receives a confirmation.
At the final agreement (upon the tenant’s booking confirmation) a deposit of 20% of the total price is payable within seven days after the bill date which is to be deposited on the account mentioned in the said booking confirmation. This will be credited to the total price. In the case that the affirmation of the tenant’s booking confirmation and the beginning date of occupancy are less than 4 weeks apart, then the tenant is not obliged to pay the previously stated deposit. When the deposit does not arrive before the deadline, then Sunshine-private.com is entitled to withdraw from the contract, after having sent a reminder notification. The tenant is then expected to calculate the total sum of cancellation fees as in compliance to the contract. The final payment is to be transferred no more than 4 weeks before. When the final payment does not arrive before the deadline, then Sunshine-private.com is entitled to withdraw from the contract, after having sent a reminder notification. The tenant is then expected to calculate the total sum of cancellation fees as in compliance to the contract. The tenant may not claim the right to move onto the property or claim contracted services before making a complete payment, although a booking confirmation has been handed over.

Services
The range of the contracted services are devoted exclusively to the service description (internet, brochures). Collateral agreements, which change according to the contracted services, require an explicit confirmation from Sunshine-private.com.

Withdrawal by Customer’s Request
The tenant may at any time withdraw from the contract before the contract becomes valid. In the case of withdrawal, the sum of the cancellation fees will stay in compliance to what is stated in the contract. When no trip is made without an explicit withdrawal declaration, the tenant remains obligated to complete a full payment. When a trip is made later than as previously scheduled, or a trip ends earlier than as previously scheduled, the tenant may not claim a refund. This is also effective in such cases as illness where the tenant is not responsible, and our services are unable to be delivered. Therefore, purchasing insurance for travel cancellation fees is highly recommended!

Withdrawal by Sunshine-private.com’s Request
Sunshine-private.com, or an agency strictly concerning the authorized owner, may cancel the contract after the beginning date of occupancy when the tenant does not adhere to the enforcement of the contract, regardless of a notification by Sunshine-private.com, the owner, or a local representative of Sunshine-private.com. Withdrawal may also occur if the tenant behaves contrary to the terms of the contract where the immediate annulment of the terms of the contract is justifiable. This is especially effective when behavior, contrary to the terms of the contracted occupancy of property, continues after a sent notification. Such behavior includes overcrowding of property, violation of the rules of residency, disturbances or crude, neglectful damage to the contracted property. Sunshine-private.com may cancel the contract in these cases and maintain the right to the total price.

Special Duties of the Tenant
The guests are obligated to carefully handle the property and to contact Sunshine-private.com, the owner, or the local representatives of Sunshine-private.com as soon as any damage and/or defects occur during the time of occupancy. The guests are also obliged to do what is reasonably in their power to help repair any of the defects and possible service disturbances and to maintain any possible damage. The price does not include the final cleaning of dishes, the stove, the oven, the refrigerator or kitchen appliances. These must be left behind in clean and perfect condition. Any contamination or damages to the apartment’s furnishings will be calculated separately. Any compensation contributions, resulting from the preceding regulations, must be paid by the tenant from the departure of the owner or his representative onwards. Pets may accompany the tenant only by previous approval. Species and size are to be indicated.

Obligations and Dismissal of the Customer, Expulsion Deadline
Corresponding to the legal obligations from §651 d Abs. 2 BGB, the tenant is obligated to notify Sunshine-private.com and the owner, respectively the local representatives, of occurring defects and to extend a solution. Sunshine-private.com provides the name, address and telephone number of the owner, respectively the local representatives, in the booking confirmation. Rights to the termination of the contractual relationship are excluded.

Liability
Sunshine-private.com is in no way liable for physical damage resulting from deliberate or crude carelessness of the tenant to the rented items. Maximum liability is restricted to the total renting price. Sunshine-private.com is particularly not liable for larceny of any and all kinds. Sunshine-private.com is also not liable for service disturbances, including services which are found to be foreign services (i.e. flights and rental cars) and which will be identified in the travel advertisement, in respects to the booking confirmation. Should one of the above regulations be ineffective or become ineffective, so remains the remaining regulations nevertheless valid, and the ineffectiveness of the contract stays untouched.

Concluding Regulations
For this agreement, whose enforcement is effective exclusively through the law of the Federal Republic of Germany, the legal domicile is measured by the domicile of Sunshine-private.com at the beginning of the agreement. Should one of the regulations of this agreement be ineffective or become ineffective, so will the validity of the above regulations remain untouched.
